The project is subject to stringent permitting and licensing requirements under the Federal Energy Regulatory Commission (FERC) and the U.S. Department of Interior, Bureau of Land Management (BLM), and Bureau of Reclamation (USBR), as well as other local and state permitting authorities and also requires maintaining good stakeholder relations.

The Seminoe Pumped Storage Project is being developed by Black Canyon Hydro, LLC (Black Canyon Hydro), a subsidiary of rPlus Hydro. On April 20, 2020, Black Canyon Hydro filed a Notice of Intent to File License Application, Pre-Application Document (PAD) and Request to Use the Traditional Licensing Process (TLP) with the FERC, the federal agency with jurisdiction over non-federal hydropower projects in the United States. FERC approved the use of the TLP on June 3, 2020.

A Joint Meeting and site tour were held on July 21, 2020 to discuss the project. Comments on the PAD and/or study requests were requested by September 19, 2020. Black Canyon Hydro received four comment and/or study request letters from interested agencies or stakeholders. Study plans were developed in winter 2021 and distributed to stakeholders for comment on March 23, 2021. Environmental studies were conducted during 2021, some additional study work will be completed by spring 2022. A Draft License Application (DLA) was filed with FERC in June 2022. Black Canyon Hydro received several agency comment letters to the DLA. In January 2023, Black Canyon submitted a Final License Application to FERC. Subsequently, FERC requested 4 additional studies to be completed by Black Canyon Hydro. The additional studies will be completed and filed with FERC by August 2024.
